Terms of Service

These Terms of Service govern your use of the Shalomly website, mobile application, and related services operated by Harpyx.

1. Who We Are

Shalomly is operated by Harpyx. In these terms, “Shalomly,” “we,” “us,” and “our” refer to Harpyx and the Shalomly services. You can contact us at contact@harpyx.com.

2. Scope and Acceptance

These terms apply to your use of the Shalomly website, mobile app, accounts, content, and related services. By accessing or using Shalomly, you agree to these terms. If you do not agree, do not use Shalomly.

3. Eligibility and Accounts

You must be legally capable of entering into these terms and must provide accurate, current information when signing up or contacting us. Shalomly is not intended for anyone under 13. If you create an account, you are responsible for your login credentials and for activity that occurs under your account.

We may suspend or restrict access if we reasonably believe your account is being misused or creates risk for Shalomly or others.

4. Spiritual and Wellness Disclaimer

Shalomly offers blessings, Tehilim, the weekly Torah portion, and Mussar reflections to support a personal daily practice. It is provided for spiritual reflection, learning, and wellbeing purposes only.

Shalomly is not a substitute for guidance from a rabbi or other qualified religious authority, and it does not render halachic rulings. Practices, customs, translations, and transliterations vary between communities and traditions, and the content in the app may not reflect the custom you follow.

Shalomly is also not medical care, mental health treatment, crisis support, or a substitute for licensed professional advice, diagnosis, or treatment. If you believe you may be in danger or need urgent help, do not rely on Shalomly. Contact local emergency services or a qualified professional immediately.

5. Subscriptions, Billing, and App Stores

Some Shalomly features may be offered on a paid or subscription basis. Purchases may be processed by Apple, Google, or another payment provider, and their billing, cancellation, renewal, and refund terms may also apply. Unless applicable law or the relevant app store requires otherwise, fees are non-refundable once a billing period begins. We may change pricing or paid feature availability prospectively.

6. Availability, Changes, and Discontinuation

We may add, remove, modify, suspend, or discontinue any part of Shalomly at any time, including features, content, integrations, or app store availability. We do not guarantee that Shalomly will always be available, uninterrupted, or error-free.

If we discontinue a paid service before the end of a prepaid term and cannot continue providing substantially the promised service, any refund, credit, or other remedy will be limited to what is required by applicable law or the relevant app store.

7. Acceptable Use

You may not use Shalomly to break the law or harm others. You may not interfere with Shalomly, access accounts or data that are not yours, scrape or copy the service at scale, reverse engineer the service except where law does not allow that restriction, or use Shalomly to infringe intellectual property or other rights.

8. Intellectual Property

Traditional Jewish liturgical and scriptural texts are part of a shared heritage, and we claim no ownership over them. The Shalomly service itself, including its software, branding, design, audio recordings, original commentary and Mussar material, translations, and the selection and arrangement of content, is owned by Harpyx or its licensors and is protected by applicable intellectual property laws.

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use Shalomly for your personal, non-commercial use.

9. Disclaimers

To the maximum extent permitted by law, Shalomly is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We do not promise that Shalomly will meet every expectation, achieve any particular result, or operate without delay, interruption, or error.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to Shalomly will not exceed the amount you paid for the applicable paid service during the 12 months before the event giving rise to the claim. Nothing in these terms limits liability or consumer rights that cannot be limited or waived under applicable law.

11. Termination

You may stop using Shalomly at any time. We may suspend, limit, or terminate access if you violate these terms, create risk or legal exposure, misuse the service, or if we discontinue Shalomly.

12. Changes to These Terms

We may update these terms from time to time. If we do, we will post the updated version here and update the effective date above. By continuing to use Shalomly after the updated terms take effect, you agree to the revised terms.
